五年，全面控烟？

“五年，在省一级城市实现100%的公共场所无烟。五年，在公共场所看不到任何形式的烟草广告。五年，把中国从世界最大的烟草消费国转变为世界最积极有效的控烟国……”这份五年控烟蓝图，诞生于3月24日中国疾控中心的控烟研讨会上。
当很多人用“理想化”、“形式主义”、“口号”来形容这张蓝图时，卫生部出台了《公共场所卫生管理条例实施细则》（下称《细则》），规定从5月1日起，室内公共场所禁止吸烟。
专家说：“这是一个信号，意味着中国控烟开始了新一轮的战斗！”某烟草企业品牌战略部经理说：“有用吗？又不是没管过。”正在广场上吸烟的市民说：“不知道，没人管。”
难道这张蓝图又是一次纸上谈兵？
控烟失败催生新“禁烟令”
中国疾控中心副主任、国家控烟办主任杨功焕表示，《细则》的出台缘于“中国式控烟”的失败和“十二五”控烟新规划的实施。
2003年，中国签署了世界卫生组织《烟草控制框架公约》，公约于2006年1月正式生效。2010年1月，禁烟工作阶段性报告——《控烟与中国未来中外专家中国烟草使用与烟草控制联合评估报告》发布，中国关键政策的执行平均得分仅为37.3分，中国总吸烟人数为3.56亿，与2002年比几乎没有变化。
中国控烟协会专家、北京控烟协会副秘书长崔小波对《中国经济周刊》说：“全国公共场所禁烟规定下得越晚，对国民健康的损害就会越大。所以根据我国履约工作的时间表，2011年必须出台全国性的室内公共场所禁烟的法律法规。”
而“全面推行公共场所禁烟”纳入“十二五”规划纲要，在杨功焕看来，为我国控烟工作确立了“路线图”和“时间表”，是里程碑式的进步。
杨功焕认为，我国控烟工作应该明确路线。“全面推动支持公共场所禁烟的国家立法，各地政府建立保障机制、开展控烟项目活动，包括实际控烟成效的跟踪监督评估机制”。
目前，我国控烟工作已经迈出了第一步，2010年5月，中国控烟法律专家工作组正式成立，这标志着法律专家整体介入烟草控制立法工作，呼吁了多年的“控烟立法”终于有了眉目。
而“时间表”，在杨功焕看来，是指今年应该有一半的省级城市，特别是已颁布地方控烟法规的城市，达到公共场所完全无烟的目标。在“十二五”收官之年，理想的状态是在省一级城市，实现100%的公共场所无烟。五至十年后，我国应该达到“在室内公共场所看不到有人吸烟、闻不到烟味，所有公共场所看不到和听不到任何形式的烟草广告、促销和赞助，不再有向青少年销售香烟或由青少年销售烟草制品的现象。”杨功焕说。
禁烟令的“三大疑惑”
据统计，我国出台公共场所禁烟地方性法规的城市有154个，占地市级城市的一半，可是论起收效，却不免都让人失望。同样，《细则》刚刚颁布，就有人质疑，“这是不是又一次雷声大雨点小的开始？”
首先，对于“公共场所”的范围没有明确界定。
杨功焕称，根据《烟草控制框架公约》的要求，公共场所应该是指所有的社会活动场所，包括一般意义上的宾馆、饭店、影院等经营性的室内公共场所，也包括办公室、生产车间等工作场所，公交车、出租车、地铁等公共交通工具，以及医院、校园、公园等公益性、社会性的公共场所。
但是，《细则》中并没有对“公共场所”做任何注解，尤其是公众关心的“公共场所是否包含办公室”没有明确示意。
崔小波认为：“要执行好这个规定，还需要各省市针对公共场所制定本地的无烟环境立法措施，具体落实减少烟草危害的具体目标。”
卫生部新闻发言人邓海华在接受《中国经济周刊》采访时回复说，卫生部正在对《细则》进行修订，修订后将增加“室内公共场所禁止吸烟”及其他有关控烟的规定，这表明了我国政府积极履约控烟的决心和努力。
另外，对违规者将如何约束和惩罚也是《细则》中极其模糊的一点。在《细则》的“法律责任”章节中，并没有任何有关禁烟内容的追责和惩戒条文，很多人认为，“禁烟”成了“无力的枷锁”。
崔小波则解释说，禁烟需要一个过程，罚款并非是唯一的办法。“根据我国的禁烟情况可以发现，对禁烟法规宣传得好的地方，执法的阻力就小，反之执法的阻力就很大。所以，在法规执行前几个月的时间里，各省市都要加大烟草危害的宣传教育工作，利用一切机会和公益广告时间宣传卫生部的禁烟令。”因此，与公众“重罚”的思路不同，新“禁烟令”将以劝解和宣传为主要执行方法。
第三个疑惑在于，“禁烟令”的实施需要调配大量的人力做监督劝解工作，动用物力修建在公共场所配置的吸烟室，动用财力做宣传工作。那么，谁来买单呢？
“室内公共场所禁烟工作是以各经营单位为主体的自律性工作，一般来讲，主要有建立场所禁烟制度，在醒目的地方张贴禁烟标识和警语，去除烟灰缸，培训工作人员，安排劝阻吸烟专职公共卫生检查人员等。这些工作产生的费用一般由经营单位自己承担。”崔小波介绍说，“对于执法检查，公众宣传、举报电话和法庭听证等费用由当地卫生行政主管部门支付。”
落地仍有难度
西安市解放路的某写字楼内，十几家国内知名烟草企业的广告公司正在疯狂地跑马圈地，因为初春时节正是烟草销售的“小旺季”。“我们正在抓紧铺货，一天至少要给100家商店换上我们冠名的招牌，大家都在抢地盘。”某烟草企业品牌战略部经理说。
当记者提及新“禁烟令”时，这位经理说：“我们铺都来不及了，还禁什么呀，这‘禁烟令’也不是第一回了吧，我们铺了那么多年，从来没人管。”据他介绍，最近电视广告总吃官司，管得严了，烟草广告就以户外为主，尤其是大型展板和商铺冠名的方式。“商铺冠名最好，商店老板帮我们保护着，又省钱又高效。”
“公共场所是烟草企业品牌宣传的好场所，‘禁烟令’必然使烟草企业失去了一个宣传自身品牌的阵地。”中投顾问食品行业研究员周思然对《中国经济周刊》说，“但是，能否有成效还得取决于‘禁烟令’的执行情况。此外，在吸烟习惯根深蒂固的烟民面前，这种缺乏强有力监督的‘禁烟令’所能起到的作用令人怀疑。”
“我国公共场所禁烟，只有正视烟草和‘二手烟’的危害，制定全面的、具有可操作性的法规才是可行之举。”清华大学法学院教授王晨光认为，应该以《烟草控制框架公约》为标尺，借鉴国外和我国港台地区的成功立法经验，选择科学可行的执法模式，推动我国公共场所禁烟法治运动。“否则，‘禁烟令’的结果就是屡禁不止。”

梁晨，男，生于1986年，湖南怀化人。因生于清晨而得名，兼取“良辰美景”之意。2004年——2008年于湘潭大学法学院学习，获法学学士学位。曾任本科班长职务，管窥象牙塔中的勾心斗角与利益角逐，心中不免感慨万千，故放弃名利，潜心求学。不料学海无涯，习法近十载，至今茫茫无所为。2005年光荣加入中国共产党。2007年获得湘潭大学推荐免试攻读硕士学位资格。 2009年通过国家司法考试。2008至2011年于湘潭大学法学院法学理论专业学习，师从胡平仁教授。其硕士论文《二元人格权论》经答辩委员会专家一致评定为“优秀”。2011年参加清华大学博士研究生入学考试，入围复试，惨遭淘汰。遂闭关修炼，翌年再战。2012年喜获清华大学录取，攻读法学博士学位，师从王晨光教授。现博士在读，主要研究方向为法理学、医疗卫生法学。
